End-User License Agreement (EULA) for Resilient

1. Acceptance of Terms

By downloading, installing, or using Resilient ("Application"), provided by Resilient SA ("Company"), located in Lausanne, Switzerland, you agree to be bound by the terms of this agreement. If you do not agree to these terms, do not use this Application.

2. License Grant

The Company grants you a non-exclusive, non-transferable, revocable license to use the Application for the purpose of participating in the beta testing and providing feedback. The Application is available for download on Apple’s App Store for iOS devices and Google’s Play Store for Android devices.

3. Acceptable Use and Beta Testing

The Application is currently in a beta testing phase. Features may not work as expected, and the chatbot may make errors. Users are encouraged to provide feedback but are not required to report errors or bugs. Users should use common sense when interacting with the chatbot.

4. Intellectual Property Rights

All intellectual property rights in the Application are owned by Resilient SA. Users are advised not to share proprietary content from the Application, including the chatbot screen, to protect their privacy and the Application's intellectual property.

5. Data and Privacy

a. The Application does not use data collected during the beta testing to train algorithms. Data collection is solely for the purpose of improving the Application.

b. OpenAI, as per agreements with Resilient SA, will not use data from our API to train their algorithms.

c. Amazon Web Services (AWS) does not access data stored within the Application. All data is stored encrypted and is inaccessible to AWS.

6. Disclaimer of Warranties

The Application is a beta version and is provided "as is" without warranties or guarantees of functionality. Report any issues via the app's help function. Concerned users are advised to uninstall the Application and report issues to support@resilient.ai.

7. Limitation of Liability

Resilient SA is not liable for any misbehavior of the Application during the beta phase. The app is sandboxed and will only access data within the user's granted permissions.

8. Indemnification

Users are not required to indemnify the Company during the beta testing phase of the Application.

9. Governing Law and Jurisdiction

This EULA shall be governed by the laws of Switzerland, with any disputes or litigation to be conducted in English in Lausanne, Switzerland.

10. Changes and Modifications

The Company reserves the right to modify the Application and its terms at any time. Changes will be communicated within the app.

11. Termination

The Company may terminate the beta testing or your access to the Application at any time. Users may also choose to terminate their participation by emailing support@resilient.ai for offboarding instructions. Once the beta is concluded, users will be informed accordingly.
